Terms of Use


Article 1 General Provisions

These Terms and Conditions apply to all matters pertaining to the use of the shopping website “Yamada-Matsu Online Shop” (hereinafter referred to as the “Website”), managed by Yamada-Matsu Co., Ltd. (hereinafter referred to as the “Company”), by members.


Article 2 Application for a Membership

・Those who wish to use the Website as a member must follow the prescribed application procedures to become a member.

・Those wishing to become a member of the Website shall apply for a membership through the procedures prescribed by the Company.

・In the case where a person who wishes to become a member of the Website is a minor, an adult ward or a person under curatorship, the person shall apply for a membership with the consent of his/her statutory agent, guardian or curator.

・Those who have applied for a membership shall be regarded as having agreed to the content of these Membership Terms and Conditions at the point of submitting the application.

・The Company shall review and approve the membership application. The application may not be approved if it is found incomplete or deemed inappropriate for other reasons.

・Individual or juridical persons whose membership application is approved by the Company shall obtain the right to receive services from the Company as a member of the Website (hereinafter referred to as the “Membership”).



Article 3 Membership


・Membership on the Website is limited to one per individual or juridical person.

・Members may not give, sell or lend their Membership on the Website to a third person or another member nor let them use it.



Article 4 Member’s Obligations

・Members shall arrange communication devices and lines and softwares that are necessary for using the Website at their own cost and responsibility.

・It is each member’s responsibility to manage his/her user ID and password that were issued when he/she became a member. Any indication of intention under a valid user ID and password, even used by a third party, shall be considered a valid indication of intention of the Member concerned him/herself.

・Members shall promptly notify the Company of any changes to the information they have registered at the time of application.

・Members shall not engage in any of the following acts.

1)False statement on the application form

2)Allowing a third party or another member to access the Website without the permission of the Company

3)Violating the rights of the Company, a third party or another member

4)Defaming the Company, a third party or another member

5)Obstructing the operation of the Website or discrediting the Company

6)Using, disclosing or transmitting the information obtained on the Website without the permission of the Company

7)Transmitting or writing harmful computer programs

8)Violating laws and ordinances, offending public order and morals, or other acts considered by the Company as similar acts

9)Other acts that the Company deems inappropriate


Article 5 Termination of Membership

Members shall lose their membership in the event of any of the following:

1)When a member notifies the Company of his/her intention of withdrawing from membership and the Company accepts the notification

2)When the Company decides that a member has engaged in one of the prohibited acts listed in Article 4

3)When the continued operation of the Website has become difficult due to natural disasters or other reasons

4)Other cases where the Company deems that termination of membership is necessary



Article 6 Copyright

・The copyright of the contents of the Website belongs to the Company unless otherwise specified. Members shall not use them beyond the scope of private use.

・The Company reserves the right to use the works registered on the Website by members within the scope necessary for the operation of the Website.

・Members shall not exercise or claim to the Company the copyright on the work they registered on the Website.


Article 7 Protection of Personal Information

The Company will entrust its subcontractor with the information that can identify individuals (names, addresses, telephone numbers, e-mail addresses etc.), which members provided at the time of joining membership, within the scope necessary for offering services of the Website. Other than that, such information will not be disclosed outside the Company unless with the consent of the member concerned him/herself. Details on the handling of personal information are as stipulated in the separate “Privacy Policy”.

Article 8 Disclaimer

・The Company reserves the right to change the content of the Website or suspend or terminate its services without prior notice in one of the following cases.

1)Maintenance, checkup, repair and alteration of the Website and its installation environment.

2)Unforeseen circumstances such as fires, blackouts, earthquakes, volcanic eruptions, floods, tsunami, wars, riots and industrial disputes

3)Other circumstances as deemed necessary by the Company

・The Company shall not be liable for any damages caused by changes to the content of the Website or suspension or termination of its services made at the discretion of the Company.

・The Company shall take no responsibility for the contents of the information that members have registered on the Website nor the maintenance of such information. The Company also reserves the right to change or delete at its own discretion the information registered on the Website by members.

・The Company shall not be liable for unauthorized use of a member’s user ID or password by a third person.

・The Company shall not be liable for any other damages caused by use of or inability to use the Website.


Article 9 Changes to Terms and Conditions

・The Company reserves the right to make changes to these Terms and Conditions any time at its own discretion.

・The Company shall notify members of the changes made to these Terms and Conditions through notification on the Website or other means that the Company considers reasonable.

・Changes to these Terms and Conditions shall come into effect on the thirtieth day from the day the notification was made, or on the day specified by the Company.

・If a member does not indicate his/her intention of withdrawal of membership to the Company between the period from the time of receipt of the notification of change to the day the change becomes effective, the member shall be considered to have accepted the change to these Terms and Conditions.



Article 10 Jurisdiction by Agreement

・All disputes that may arise in relation to the use of the Website are subject to Japanese law regardless of the contents, and the court having jurisdiction over the location of the head store of the Company shall be the agreement jurisdictional court.

・All disputes arising between a member and a third party or another member shall be settled at the member’s own responsibility and cost.

These Terms and Conditions come into effect from June 29, 2012.
